ACKNOWLEDGMENTS & UNDERTAKINGS
For the purposes
of this acknowledgment and undertaking:
"the Product"
means the pharmaceutical product or products you have selected on the
Order Page of this Web Site
"the Product Data
Sheet" means any information on the Product available in from this Web
Site
In all cases:
- I agree that
the laws of New Zealand shall apply in interpreting all terms of the
agreement for the supply of the Product to me.
- I agree that I am responsible for all customs duty, tariffs,
and/or taxes (if any) that may arise if the Product is to be delivered
to me outside New Zealand.
CONSUMER GUARANTEES ACT
1993 (NZ)
- The Consumer
Guarantees Act 1993 contains consumer safeguards which may apply to
the goods or services we provide to you.

The Act does not apply if you acquire the goods or services or hold
yourself out as acquiring the goods for any of the following purposes:
- Re-supplying them in trade; or
- Consuming them in the course of a process of production or manufacture;
or
- Repairing or treating in trade other goods.
- You agree that
the Act will not apply if you acquire, or hold yourself out as acquiring,
the goods or services for the purposes of a business.
EXCLUSION OF ALL OTHER
LIABILITY
- We have explained
that you may have rights under the Consumer Guarantees Act 1993. We
now exclude all other liability we may have to you. This exclusion
also applies for the benefit of all our employees and contractors
including pharmacists.
- You release
all of us from any and all liability that may arise from your use
of the Product including adverse effects you may suffer.
- None of us
are liable to you or have to pay you for anything caused by or resulting
from anything any of us does or does not do or delays in doing, whether
or not it is contemplated or authorised by the agreement you have
with us.
- This exclusion
applies whatever you may claim for and however liability arises or
might arise if it were not for this exclusion.
- This exclusion
does not prevent you from requiring us to do anything we have agreed
to do and does not limit any rights you may have under the Consumer
Guarantees Act 1993.
LIMITATION OF OUR LIABILITY
- We have explained
your rights to claim compensation from us under the Consumer Guarantees
Act 1993 and excluded all other liability we or any of our employees
or contractors including pharmacists may have to you. If any us is ever liable
to you and, for any reason, any of us cannot rely on the exclusion
of liability set out above, then the maximum combined amount all of
us (together) will have to pay you and anyone who uses the goods and
services we provide for you (together) is no more than the total amount
you have paid to us for the goods or services.
- This limitation
does not limit any rights you may have under the Consumer Guarantees
Act 1993.
PERSONAL INFORMATION
NOTICE
- This notice
relates to the information you will be providing to IT Pharmaceutical
Supplies Ltd.
- The Privacy
Act 1993 (NZ) gives you the right to see and correct the information.
- This information
may be used to further your relationship with us including to advise
you on any products supplied by us, either related to or not related
to the Product you have ordered, or for market research. If you do
not wish to receive any further communications from us please indicate
this on the order form you are about to complete.
- In respect of
the personal medical details you may provide, we will be providing
this information to a Doctor.
- If you fail
to provide any of the medical information requested, we will be unable
to process your order.
